Terms and Conditions
§ 1. GENERAL PROVISIONS

The Regulations define the rules for using the Online Store available at https://sartor.com.pl, including terms for placing orders, concluding distance sales contracts, payments, delivery, withdrawal from the contract, and complaint procedures.

The sartor.com.pl online store is operated by Michał Gąsiewski, conducting business activities at Armii Ludowej 6/152, 00-571 Warsaw, NIP 7011243974, REGON 540766959.

Using the Store implies acceptance of these Regulations.

The Regulations are available free of charge on the Store's website and can be downloaded, saved, and printed.

The provisions of these Regulations are not intended to exclude or limit the Consumer's rights granted to them by applicable law.
§ 2. DEFINITIONS

Seller - Michał Gąsiewski, conducting business activities at the indicated address.

Store - the online service available at https://sartor.com.pl.
-
Client - any entity making purchases in the Store in accordance with the Regulations.

Consumer - a natural person performing a legal act not directly related to their business or professional activity.

Goods - movable property offered in the Store.
-
Tailoring Service - a product or service made according to the Client's specifications or to meet their individualized needs.
-
Sales Agreement - a contract for the sale of Goods or Tailoring Services concluded at a distance.
-
Order - a declaration of will by the Client aimed at concluding a Sales Agreement.

Client Account - an individual panel in the Store allowing access to Client data and order history.

Regulations - this document.

§ 4. TECHNICAL CONDITIONS

To use the Store's services, a device with Internet access, a web browser supporting JavaScript and cookies, and an active email account are required.

The Seller uses cookies in accordance with the Privacy Policy available in the Store.

The Client is responsible for ensuring the compatibility of their hardware and software with the technical requirements of the Store.
§ 5. REGISTRATION AND ACCOUNT

The Client can register in the Store by creating an Account.
-
Registration in the Store is voluntary and free of charge.
-
During registration, the Client provides accurate data.
-
The Client may request the deletion of their Account at any time by contacting the Seller.
-
The Seller has the right to block the Account of a Client who violates legal provisions or the provisions of the Regulations.
§ 6. ORDERS

Information about Goods and Services in the Store constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.

The Client places an Order via the order form available in the Store.
-
Placing an Order requires acceptance of the Regulations.
-
After placing an Order, the Seller promptly confirms its receipt, which constitutes acceptance of the Client's offer and conclusion of the Sales Agreement.
-
For Tailoring Services, the condition for execution may be additional agreement on specifications (e.g., providing measurements).
§ 7. PRICES AND PAYMENTS

Prices in the Store are expressed in Polish zlotys and include VAT.
-
The price stated for the Goods is binding at the time of placing the Order.

The Seller provides the following payment methods:
-
online payment (Shopify Payments, Przelewy24, PayU – depending on Shopify integration),
-
traditional bank transfer to the Seller's bank account.

For traditional bank transfers, payment should be made within 7 days of placing the Order.
-
The Seller may limit available payment methods for specific Orders or Clients.
§ 8. DELIVERY
-
Delivery of Goods takes place in Poland via courier companies or InPost parcel lockers (if such an option is available).
-
Delivery costs are provided during the ordering process.
-
The order fulfillment time is indicated in the Goods description or agreed individually for Tailoring Services.
-
The Seller is not responsible for delays resulting from the carrier's actions.
§ 9. TAILORING SERVICE

The service involves making clothing based on individual dimensions or Client preferences.
-
A condition for execution is the provision of all required information by the Client.
-
The Seller may require a deposit or full prepayment.
-
The fulfillment time is determined individually.
-
In accordance with Article 38 point 3 of the Consumer Rights Act, the Consumer is not entitled to withdraw from the contract in the case of Tailoring Services.
§ 10. RIGHT OF WITHDRAWAL FROM THE CONTRACT (READY-MADE GOODS)

The Consumer has the right to withdraw from the sales contract for ready-made Goods without giving a reason within 14 days from the date of receipt of the Goods.
-
To exercise the right of withdrawal, the Consumer should inform the Seller of their decision in an unambiguous manner (e.g., by email or in writing).
-
The Consumer may use the sample withdrawal form available at the end of the Regulations.
-
The Consumer is obliged to return the Goods immediately, no later than 14 days from the day on which they informed about the withdrawal.
-
The Consumer bears the direct costs of returning the Goods.
-
The Seller refunds all received payments (including the cost of delivery to the Consumer) no later than 14 days from receiving the returned Goods or proof of their dispatch.
-
The refund is made using the same payment method used by the Consumer or another method agreed with the Consumer.
-
The Consumer is liable for any diminished value of the Goods resulting from their use beyond what is necessary to establish their nature, characteristics, and functioning.
-
The right of withdrawal does not apply to Tailoring Services.
§ 11. COMPLAINTS AND REPORTING NON-CONFORMITY

The Seller is liable to the Consumer for the conformity of the Goods with the contract in accordance with the provisions of the Act of May 30, 2014, on Consumer Rights and the Civil Code.

In case of non-conformity of the Goods with the contract, the Consumer may file a complaint.

A complaint can be submitted:

The complaint notification should include:
-
Client's name and surname,
-
order or invoice number,
-
description of the problem,
-
preferred method of resolving the complaint (e.g., repair, replacement, refund).

The Seller will respond to the complaint within 14 calendar days of its receipt.
-
If the complaint is accepted, the Seller will take action to fulfill the Consumer's claims in accordance with applicable legal provisions.

The advertised Goods should be sent back along with proof of purchase and a description of the defect to the Seller's address.
-
Complaints regarding the tailoring service are considered individually, taking into account the nature of this service and the possibility of correcting the execution.
§ 12. PERSONAL DATA

The administrator of the Client's personal data is Michał Gąsiewski.
-
The Client's personal data is processed for the purpose of order fulfillment, Client account management, complaint handling, invoicing, and - if consent is given - for marketing purposes.

Data is processed in accordance with applicable law, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
-
The Client has the right to access, rectify, erase, restrict processing, port, and object to the processing of their data.
-
Providing personal data is voluntary but necessary for concluding the contract and fulfilling the order.

Details regarding the processing of personal data can be found in the Privacy Policy available on the Store's website.
§ 13. OUT-OF-COURT DISPUTE RESOLUTION

The Consumer has the right to use out-of-court methods of dispute resolution, including:

mediation conducted by provincial inspectorates of the Trade Inspection,
-
permanent consumer arbitration courts,
-
the ODR platform available at: https://ec.europa.eu/consumers/odr.

To use out-of-court dispute resolution methods, the Consumer should submit a complaint directly to the Seller and - if it is not resolved positively - use the available institutions indicated above.
§ 14. FINAL PROVISIONS

The Regulations are valid from the date of their publication on the Store's website.

The Seller reserves the right to amend the Regulations for important reasons, such as changes in legal provisions or expansion of the offer.

Changes to the Regulations do not affect agreements concluded before their effective date.
-
Matters not regulated by these Regulations shall be governed by Polish law, in particular the Civil Code, the Act on Consumer Rights, and the GDPR.

Disputes arising from the performance of contracts concluded by the Store shall be resolved by common courts having local jurisdiction in accordance with applicable regulations.
